This policy explains what personal information we collect when you visit weareblackness.com or place an order, how we use it, and who we share it with.

 

The site is operated by Les Studios AKH inc. (Quebec Business Number 1180038698), P.O. Box 51587, Boulevard Édouard Station, Longueuil, Quebec J4V 2H3, Canada. This company decides how your information is used and is accountable for it.

What we collect

Device information. Your browser version, IP address, time zone, pages and products viewed, search terms, and how you move through the site. This is collected automatically through cookies, log files and pixels as soon as you reach the site. It lets us display the site correctly and understand how it's used.

Order information. Name, billing address, shipping address, payment details, email address and phone number. We use it to perform our contract with you: process payment, arrange shipping, send confirmations and invoices, communicate with you, and screen for fraudulent orders.

Customer support information. The content of your messages and the contact details you give us when you write. Used only to answer you.

Who we share it with

Shopify Inc. hosts our store and processes orders and payments. Your data is stored in the United States. Shopify's policy: https://www.shopify.com/legal/privacy

PODpartner prints and ships your orders. It receives your name and shipping address.

Printify is a print supplier whose app remains installed on our store. It may receive the same information if an order is routed to it.

MailerLite handles our email sends if you subscribe to our communications.

Meta (Facebook and Instagram), Google and YouTube, Pinterest and TikTok receive information about your browsing and purchases, through pixels installed on the site and through direct server-to-server transfers. These transfers let us measure our advertising and show you targeted ads. They happen even when cookies are blocked.

We may also disclose your information to comply with the law, respond to a lawful request, or protect our rights.

We do not sell your personal information.

Cookies and targeted advertising

Our site uses cookies that are essential to the store working at all (cart, session, checkout, account login), audience measurement cookies, and advertising cookies.

If you're in the European Economic Area or the United Kingdom, a banner lets you accept or refuse non-essential cookies before they're set.

If you live in a US state with a privacy law, you can opt out of your data being shared for targeted advertising through the dedicated page linked in the site footer.

You can also opt out of targeted advertising directly with the platforms, in the ad settings of your Meta, Google, Pinterest or TikTok account.

We don't change our practices in response to "Do Not Track" signals, as there's no agreed standard for how to respond to them.

Automated decision-making

We do not carry out any fully automated decision-making that produces legal effects or otherwise significantly affects you.

Our processor Shopify uses limited automated mechanisms to prevent fraud: temporary blocking of IP addresses after repeated failed transactions, and temporary blocking of cards linked to those addresses. These measures last from a few hours to a few days.

Lawful bases

If you live in the European Economic Area, we process your information on the following bases: your consent, performance of our contract with you, compliance with our legal obligations, and our legitimate interests where they don't override your fundamental rights.

Retention

We keep order-related information for as long as our accounting and tax obligations require, then delete it. You can ask us to erase your data at any time, subject to those obligations.

Your rights

Wherever you live, you can ask us for access to the information we hold about you, its correction, its deletion, or its transfer to another service. Email contact@weareblackness.com.

European Economic Area and United Kingdom. You also have the right to object to certain processing and to withdraw your consent at any time. Your information is transferred outside Europe, including to Canada and the United States, for storage and processing. If you're not satisfied with our response, you can lodge a complaint with your country's data protection authority.

Quebec. Under Law 25, you have rights of access, correction, deletion and portability, and the right to be informed when your information is disclosed outside Quebec, which is the case here. United States. Depending on your state, you may have rights of access, deletion, correction and portability, and the right to opt out of your data being shared for targeted advertising. You can exercise that last right through the opt-out page linked in the footer. You may appoint an authorized agent to exercise these rights on your behalf by writing to us.

Changes

We may update this policy to reflect changes in our practices or for legal and regulatory reasons. The date below shows the last update.
