1. Who we are
weareblackness.com is operated by Les Studios AKH inc. (Quebec Business Number 1180038698), a company incorporated in Quebec, Canada, with a mailing address at P.O. Box 51587, Boulevard Édouard Station, Longueuil, Quebec J4V 2H3.
We Are Blackness is a brand of Les Studios AKH inc. In this document, "we" means Les Studios AKH inc. and "you" means anyone who visits the site or places an order on it.
Our store is hosted by Shopify Inc., which provides us with the e-commerce platform.
2. Acceptance
By visiting the site or placing an order, you accept these terms along with the policies they refer to: our returns and refunds policy, our shipping policy, our privacy policy and our legal notice. These documents form a whole.
If you don't accept these terms, don't use the site.
We may change these terms at any time by publishing the new version on this page. The version that applies to your order is the one in force when you place it.
3. Who can order
You must have reached the age of majority in your province or state of residence, or have the consent of a parent or guardian who accepts these terms on your behalf.
4. Our pieces
Our clothing is printed to order. Nothing is made in advance.
Limited editions. Some of our pieces are released in limited quantities, stated on the product page. Once an edition sells out, it is not reprinted. If a piece you ordered is no longer available, we cancel the order and refund you in full.
Images. Our presentation visuals are described in our legal notice, including the use of artificial intelligence tools. The clothing shown is real. Colour rendering may vary from one screen to another.
We reserve the right to limit quantities sold to any one person, to restrict sales to certain regions, and to discontinue any product at any time.
5. Prices and payment
Our prices are shown in US dollars and may change without notice. The price that applies is the one displayed when you confirm your order.
Prices don't include customs duties or import taxes, which may be charged to you on delivery depending on your country. Our shipping policy covers this.
You agree to provide accurate, current payment and billing information.
6. Orders
An order placed on the site is an offer to buy. The contract is formed when we confirm shipment.
We may refuse or cancel an order, in particular where a limited edition has sold out, where there is an obvious pricing or description error, where fraud is suspected, or where an order appears to be placed by a reseller. If we cancel an order you've already paid for, we refund you in full.
We'll notify you by email of any change or cancellation.
7. Shipping and returns
Delivery times, costs and conditions are set out in our shipping policy. Return and refund conditions are set out in our returns and refunds policy. Both documents form an integral part of these terms.
8. Intellectual property
All content on the site, including visuals, graphics, illustrations, texts, articles and trademarks, belongs to Les Studios AKH inc. or is used under licence.
You may not reproduce, copy, resell or exploit all or part of the site, our designs or our content without our prior written permission. Buying a garment gives you no rights over the design printed on it.
9. Prohibited uses
You may not use the site for any unlawful purpose, to solicit others to commit unlawful acts, to infringe our intellectual property rights or those of a third party, to harass, abuse, defame or discriminate against anyone, to submit false or misleading information, to transmit viruses or malicious code, to collect other people's data, to scrape the site by automated means, or to circumvent its security measures.
Any breach may result in immediate suspension of your access.
10. Content you send us
If you send us comments, ideas, suggestions or proposals, whether unprompted or at our request, you authorise us to use, reproduce, publish, translate and adapt them without restriction or compensation.
You warrant that this content infringes no third-party rights and contains nothing unlawful, abusive or malicious. You remain solely responsible for it.
We may, without being obliged to, remove any content we consider contrary to these terms.
11. Third-party links and tools
The site may link to third-party sites or give access to third-party tools we don't control. We provide them as is, without warranty. Your use of those sites and tools is your responsibility, and the relevant third party's terms apply.
12. Accuracy of information
We do our best to keep the information on the site accurate, but we don't guarantee it's always complete or current. Typographical, display, pricing, availability or timing errors can occur.
We reserve the right to correct any error and to change or cancel an order based on inaccurate information, including after you've placed it. Where that happens, we refund you in full.
13. Warranties and liability
The site and its services are provided as is and as available. We don't warrant that they will be uninterrupted, error-free, or that they will meet your expectations.
To the extent permitted by law, our total liability in connection with an order is capped at the amount you actually paid for that order. We are not liable for indirect damages, including lost profits, lost revenue, lost data or lost opportunity.
These limitations do not apply to the statutory warranties you have as a consumer. If you live in Quebec, the Consumer Protection Act continues to apply and prevails over any clause to the contrary. The same is true of the mandatory consumer protection rules of your country of residence.
14. Indemnification
You agree to indemnify Les Studios AKH inc., its officers, employees, contractors and partners against any third-party claim, including reasonable legal fees, arising from your breach of these terms or your violation of any law or third-party right.
15. Personal data
How we handle your personal information is described in our privacy policy, which sets out what we collect, who we share it with, and the rights you have.
16. Term and termination
These terms apply for as long as you use the site. You may end them by ceasing to use it.
We may end your access without notice if we consider you've breached these terms. Obligations arising before termination, including payment for orders in progress, survive it.
17. General provisions
If any clause of these terms is held invalid or unenforceable, it will be severed without affecting the validity of the remaining clauses.
Failure to exercise a right under these terms is not a waiver of that right.
These terms, together with the policies they refer to, constitute the entire agreement between you and us and supersede any earlier agreement.
18. Governing law and courts
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.
Any dispute falls to the courts of the judicial district of Longueuil, Province of Quebec, subject to any mandatory rules allowing a consumer to bring proceedings in the courts of their place of residence.
